Due to the recent Florida Supreme Court ruling, the OkaloosaCounty Commissioner Board has rescinded the portion of its beach restoration project that was not designated as "critically eroded." The Board of County Commissioners also amended the assessment resolution area to match the non-designated area eliminated from the MSBU portion in Destin.

The Florida Supreme Court ruled this week on a long-awaited decision regarding the constitutionality of beach restoration. The certified question the Court ruled on was as follows: "On its face, does the Beach and Shore Preservation Act unconstitutionally deprive upland owners of littorial rights without just compensation?"
The Court ruled 5-2 that no, the Act is not unconstitutional because restoration of a critically eroded beach does not deprive the upland owner of littoral rights. The complete ruling is available by clicking on this link.
